Fish Wins CBM Victory for Samsung at Federal Circuit
Fish filed petitions for Covered Business Method (CBM) Review at the PTAB involving patents at the center of a lawsuit filed by Smartflash, LLC, a patent holding company. Smartflash had accused a number of prominent consumer electronics companies of infringing patents for various features of consumer electronics, including wireless phones. Fish developed a PTAB strategy for client Samsung that succeeded where others had earlier struggled, and this enabled Samsung to stay its litigation with Smartflash. The PTAB found all challenged claims invalid under 35 U.S.C. § 101 as representing ineligible subject matter. After an appeal, the Federal Circuit affirmed the PTAB’s decision, invalidating the patents.
